An essential part of this triangle is the collection company, which should comprehensively cover the technical management of sorted components of municipal waste in the municipalities, and this includes sorting, pressing and other related activities, while all costs of the collection company are financed by PRO (authorized legal entity) on the basis of a contract with the collection company by the company. <\/span>
\nBased on the contract with PRO, the municipality will ensure the export of individual sorted components of municipal waste. These rules such as the type and size of containers \/ bags should be set based on mutual relationship.<\/span><\/p>\n

Within the Small Carpathian region, by the end of 2022, with the exception of a maximum of 1-2 municipalities, a contract was concluded with one PRO. <\/span>
\nAs of January 1, 2023, fragmentation and termination of contracts occurred within the Small Carpathian region, and only one original contract remained, namely the contract with the city of Pezinok. <\/span>
\nIn the case of a joint association of municipalities, e.g. within the region with one PRO, municipalities have better bargaining power, a better opportunity to set common conditions for waste collection and collection with the collection company, etc. <\/span>
\nThe variability of PRO within the year brings new system settings and new contractual conditions with collection companies.<\/span><\/p>\n

In Austria, the market leader among producer responsibility organizations is the ARA company, which ensures the legal obligation to take back and evaluate waste. There are no frequent changes in contractual relations here, as in the territory of the Slovak Republic, since the system of shared infrastructure works here. <\/span>
\nAll PROs participate in the financing of all municipalities according to their market share, and therefore there are no transfers of municipalities between PROs. <\/span>At the collection level, the system in Austria is stable, in contrast to Slovakia, where the greatest instability arises at this level.<\/span><\/p>\n

Let’s ask ourselves whether these relations between the Municipality – the Collection Company – PRO are equal and the municipalities are not “hostages” of the collection companies and PRO. The increasing financial demands and annual costs for the collection of sorted waste from municipalities are unbearable. <\/span>Municipalities in whose territory an interesting entity (manufacturer of packaging or non-packaging) is located and PRO has a contract with it, is a strong partner for the PRO municipality. <\/span>
\nToday, it is difficult to achieve a balance between producers and municipalities, which leads to the fact that every year hundreds of municipalities do not have a contract with PRO in a certain period.<\/span><\/p>\n

In the lecture, we will focus on practical problems that arise and may arise in the mutual relationship between the Municipality – the Collection Company – PRO from the point of view of the municipality and its position in this relationship triangle. Daniela Va\u0161kov\u00e1 Kas\u00e1kov\u00e1<\/strong> is a graduate of the Comenius University in Bratislava, the Trnava University in Trnava and the Police Academy in Bratislava.<\/span><\/p>\n

He continues to expand his studies and from September 2023 he will continue his doctoral studies at the Comenius University in Bratislava.<\/span><\/p>\n

For more than 12 years, she has been working in the field of environment and waste management in the positions of head of the environmental department in the city of Sere\u010f, director of a contributory organization in the Bratislava – Petr\u017ealka district and entrusted with the management of the Municipal office in the city of Pezinok. <\/span>
\nShe was actively involved in the development of educational materials in the field of waste management, the creation of educational programs for different age groups and commenting on the law on waste management.<\/span><\/p>\n

In the district town of Pezinok, she started with the idea of building a collection yard and introducing common waste collection.<\/span><\/p>\n

\nObec na z\u00e1klade zmluvy s OZV zabezpe\u010d\u00ed v\u00fdvoz jednotliv\u00fdch trieden\u00fdch zlo\u017eiek komun\u00e1lneho odpadu. Tieto pravidl\u00e1 ako druh a ve\u013ekos\u0165 kontajnerov\/vriec by mal by\u0165 nastaven\u00fd na z\u00e1klade vz\u00e1jomn\u00e9ho vz\u0165ahu.<\/span><\/p>\n

V r\u00e1mci Malokarpatsk\u00e9ho regi\u00f3nu bola do konca roka 2022, s v\u00fdnimkou maxim\u00e1lne 1 \u2013 2 obc\u00ed, uzatvoren\u00e1 zmluva s jednou OZV.
\nOd 1.1.2023 do\u0161lo v r\u00e1mci Malokarpatsk\u00e9ho regi\u00f3nu k rozdrobeniu, k vypovedaniu zml\u00fav a zostala uzatvoren\u00e1 len jedna p\u00f4vodn\u00e1 zmluva a to zmluva s mestom Pezinok. Pri spolo\u010dnom zdru\u017een\u00ed obc\u00ed napr. v r\u00e1mci regi\u00f3nu s jednou OZV maj\u00fa obce lep\u0161iu vyjedn\u00e1vaciu silu, lep\u0161iu mo\u017enos\u0165 nastavi\u0165 spolo\u010dn\u00e9 podmienky pri zbere a zvoze odpadov so zberovou spolo\u010dnos\u0165ou a i.
\nMenite\u013enos\u0165 OZV v r\u00e1mci roka prin\u00e1\u0161a nov\u00e9 nastavovanie syst\u00e9mu a nov\u00fdch zmluvn\u00fdch podmienok so zberov\u00fdmi spolo\u010dnos\u0165ami. <\/span><\/p>\n

V Rak\u00fasku je l\u00eddrom na trhu, medzi organiz\u00e1ciami zodpovednosti v\u00fdrobcov, spolo\u010dnos\u0165 ARA, ktor\u00e1 zabezpe\u010duje z\u00e1konn\u00fa povinnos\u0165 sp\u00e4tn\u00e9ho odberu a zhodnotenia odpadu. Nedoch\u00e1dza tu k \u010dast\u00fdm zmen\u00e1m v zmluvn\u00fdch vz\u0165ahoch ako na \u00fazem\u00ed Slovenskej republiky, ke\u010f\u017ee tu funguje syst\u00e9m zdie\u013eanej infra\u0161trukt\u00fary. V\u0161etky OZV sa podie\u013eaj\u00fa na financovan\u00ed v\u0161etk\u00fdch samospr\u00e1va pod\u013ea svojho trhov\u00e9ho podielu, a preto tu nedoch\u00e1dza k \u017eiadnym presunom samospr\u00e1v medzi OZV. Na \u00farovni zberu je syst\u00e9m v Rak\u00fasku stabiln\u00fd na rozdiel od Slovenska, kde najv\u00e4\u010d\u0161ia nestabilita vznik\u00e1 pr\u00e1va na tejto \u00farovni.<\/span><\/p>\n

Polo\u017eme si ot\u00e1zku, \u010di s\u00fa tieto vz\u0165ahy medzi Obcou \u2013 Zberovou spolo\u010dnos\u0165ou – OZV rovnocenn\u00e9 a obce nie s\u00fa \u201erukojemn\u00edkmi\u201c zberov\u00fdch spolo\u010dnost\u00ed a OZV. Zvy\u0161uj\u00face sa finan\u010dn\u00e9 n\u00e1roky a ka\u017edoro\u010dn\u00e9 n\u00e1klady na zvoz trieden\u00fdch odpadov z obc\u00ed s\u00fa ne\u00fanosn\u00e9. Obce, na ktor\u00fdch \u00fazem\u00ed sa nach\u00e1dza zauj\u00edmav\u00fd subjekt (v\u00fdrobca obalov alebo neobalov) a OZV s \u0148ou m\u00e1 uzatvoren\u00fa zmluvu, je pre obec OZV siln\u00fdm partnerom.
